Durian Consultants LLC complies with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States.  Durian Consultants LLC has certified to the Department of Commerce that it adheres to the Privacy Shield Principles.  If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Durian Consultants LLC takes the privacy of individuals very seriously and is committed to the Principles of Privacy Shield. In alignment with these Principals, Durian Consultants LLC processes their client’s HR and non-HR data to provide specific recommendations to improve quality and consistency. With respect to data received or transferred pursuant to the Privacy Shield Framework, Durian Consultants LLC is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission.

Durian Consultants LLC has further committed to cooperate with the panel established by the EU data protection authorities (DPAs) with regard to unresolved Privacy Shield complaints concerning human resources data transferred from the EU in the context of the employment relationship.

Durian Consultants LLC does not share personal information with any third parties. If we change this policy in the future, we will provide individuals with an opt-out or opt-in choice before we share their data with third parties

Durian Consultants LLC does not transfer personal information to any third parties. Therefore, the provision regarding liability for the actions of agent processors may not apply. If we change this policy in the future, Durian Consultants LLC shall remain liable under the Privacy Shield Principles if its agent processes such personal information in a manner inconsistent with the Principles, unless the organization proves that it is not responsible for the event giving rise to the damage.

Individuals may contact us to correct, amend or delete such personal information if it is inaccurate or has been processed in violation of the Principles (except when the burden or expense of providing access, correction, amendment, or deletion would be disproportionate to the risks to the individual’s privacy, or where the rights of persons other than the individual would be violated). Dispute Resolution: Within the scope of this privacy notice, if a privacy complaint or dispute cannot be resolved through Durian Consultants LLC’s internal processes, Durian Consultants LLC has agreed to participate in the VeraSafe Privacy Shield Dispute Resolution Procedure. Subject to the terms of the VeraSafe Privacy Shield Dispute Resolution Procedure, VeraSafe will provide appropriate recourse free of charge to you. Where required to the extent necessary to meet a legal obligation to which Durian Consultants LLC is subject, including a lawful request by public authorities and national security or law enforcement obligations and applicable law, rule, order, or regulation.
